Introduction

Zavo Nexus Private Limited ("Zavo", "we", "us", or "our") operates the RACE Engineering platform. We are committed to protecting your personal data. This Privacy Policy explains how we collect, use, store, and share your information when you access or use the Platform.

This Policy is compliant with India's Digital Personal Data Protection Act, 2023 (DPDP Act) and other applicable data protection laws.

Data We Collect

2.1 Information You Provide

Full name and email address.
Mobile number (optional).
Billing address and payment information (processed securely via Razorpay; we do not store full card details).
GSTIN (for Enterprise Users who require GST-compliant invoices).
Organisation name and designation (for Enterprise Users).

2.2 Information Collected Automatically

IP address and device information.
Browser type and operating system.
Usage logs including GPU instance start/stop times, compute duration, and resource utilisation.
Cookies and similar tracking technologies (see Section 8).

2.3 Content Data

We temporarily process data, models, and files you upload or run on GPU Instances solely to deliver the compute service. We do not access, analyse, or retain your Content beyond what is necessary for service delivery.

How We Use Your Data

To create and manage your account.
To provision and operate GPU compute resources on your behalf.
To process payments and issue GST-compliant invoices.
To send transactional communications (invoices, usage alerts, service updates).
To detect, investigate, and prevent fraud and security incidents.
To comply with legal obligations including tax, regulatory, and law enforcement requirements.
To improve and develop the Platform based on aggregated, anonymised usage analytics.

Legal Basis for Processing

We process your personal data on the following grounds under the DPDP Act and applicable law:

Contract: Processing necessary to perform the services you have requested.
Consent: Where we have obtained your explicit consent, which you may withdraw at any time.
Legal Obligation: Where we are required to process data to comply with applicable law.
Legitimate Interest: For fraud prevention, security, and internal analytics, where such interests are not overridden by your rights.

Data Sharing and Disclosure

5.1 With GPU Providers

To provision compute resources, we share limited technical information (such as job configuration and usage metadata) with our infrastructure Providers (e.g., E2E Networks, Cyfuture, AceCloud). We do not share your personal identity information with Providers without your consent.

5.2 With Payment Processors

Payment information is processed by Razorpay in accordance with their privacy policy and applicable PCI-DSS standards. We receive only transaction confirmations and tokenised references.

5.3 With Service Providers

We may share data with carefully selected third-party service providers who assist us in operating the Platform (e.g., cloud monitoring, email delivery, analytics). These providers are contractually bound to process data only on our instructions and in compliance with applicable law.

5.4 Legal Disclosure

We may disclose your data to government authorities, regulators, or courts where required by applicable Indian law or legal process.

5.5 No Sale of Data

We do not sell, rent, or trade your personal data to third parties for their marketing purposes.

Data Residency and Cross-Border Transfers

Our primary GPU infrastructure and core data storage is located within India. We are committed to data residency as a key Platform principle.

Certain ancillary services (such as cloud monitoring, email delivery, or analytics tools) may involve processing your data outside India. Where such transfers occur, we ensure appropriate safeguards are in place, including contractual protections consistent with the DPDP Act.

Data Retention

We retain your personal data for as long as your account is active or as necessary to provide you with services, comply with legal obligations, resolve disputes, and enforce our agreements. Upon account deletion:

Account and billing data is retained for a minimum of 7 years as required under Indian tax law.
Content data (uploaded files and models) is deleted within 30 days of account closure or instance termination, unless you instruct otherwise.
Usage logs may be retained in anonymised form for analytics purposes.

Cookies

We use cookies and similar technologies to:

Maintain your session and authentication state.
Remember your preferences.
Collect aggregated analytics on Platform usage.

You can control cookie preferences through your browser settings. Disabling certain cookies may affect the functionality of the Platform.

Your Rights

Under the DPDP Act and applicable law, you have the right to:

Access the personal data we hold about you.
Correct inaccurate or incomplete personal data.
Request erasure of your personal data, subject to legal retention obligations.
Withdraw consent where processing is based on consent.
Nominate a person to exercise your rights in the event of your death or incapacity (as provided under the DPDP Act).

Security

We implement reasonable technical and organisational measures to protect your personal data against unauthorised access, disclosure, alteration, or destruction. These include encryption in transit (TLS), access controls, and regular security reviews.

No method of transmission over the internet is completely secure. While we strive to protect your data, we cannot guarantee absolute security.

Children's Privacy

The Platform is not directed at individuals under the age of 18. We do not knowingly collect personal data from minors. If we become aware that a minor has provided us with personal data, we will delete it promptly.

Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes via email or a prominent notice on the Platform. The updated Policy will be effective from the date indicated at the top of this document.
